Deng Law Center

Beyond the $250,000 Barrier: Navigating California’s New MICRA Caps in 2026

For nearly five decades, families in the San Gabriel Valley and across California were shackled by the Medical Injury Compensation Reform Act (MICRA) of 1975, which placed an immovable $250,000 cap on non-economic damages in medical malpractice cases. At Deng Law Center, led by community advocate Daniel Deng, we are proud to announce that as of January 1, 2026, that era is officially over. Under the landmark Assembly Bill 35 (AB 35), the limits for "pain and suffering" in wrongful death cases have reached their highest point in history, offering a new bridge to justice for grieving families.

What is the MICRA Cap for Wrongful Death in 2026?

The flat $250,000 cap has been replaced by a tiered system that increases annually. As of January 1, 2026, the cap for non-economic damages (such as loss of companionship, grief, and mental anguish) in medical malpractice wrongful death cases is $650,000.

  • Annual Escalation: This cap will continue to increase by $50,000 each year until it reaches $1 million in 2033.
  • Non-Fatal Injuries: For cases involving injury rather than death, the 2026 cap is $470,000.

The "Stacking" Advantage: Multiplying the Recovery

Perhaps the most significant change in 2026 is the ability to "stack" caps. Under the old law, you were limited to one $250,000 cap regardless of how many doctors or hospitals were negligent. Now, a plaintiff may seek separate caps for up to three categories of defendants:

  1. A healthcare provider (e.g., an individual doctor).
  2. A healthcare institution (e.g., a hospital or clinic).
  3. An unaffiliated provider or institution involved in a separate act of negligence. In a 2026 wrongful death case involving both a negligent surgeon and a negligent hospital, the total non-economic recovery could potentially reach $1.3 million ($650,000 x 2).

Economic Damages Remain Uncapped

It is vital to remember that these caps only apply to non-economic damages. Economic damages—such as medical bills, funeral expenses, and the loss of the deceased's lifetime earnings—remain completely uncapped. At Deng Law Center, we work with economic experts to ensure that every dollar of financial loss is documented and pursued to the fullest extent of the law.
