What is the MICRA Cap for Wrongful Death in 2026?
The flat $250,000 cap has been replaced by a tiered system that increases annually. As of January 1, 2026, the cap for non-economic damages (such as loss of companionship, grief, and mental anguish) in medical malpractice wrongful death cases is $650,000.
The "Stacking" Advantage: Multiplying the Recovery
