  1. 过失致死(Wrongful Death): 在加州,普通的过失致死案通常不能申请惩罚性赔偿,除非被告因重罪谋杀被定罪。

Proving "Malice": Unlocking Punitive Damages in Fatal Accidents

In most car accidents, the law deals with negligence—a simple mistake or lack of care. In 2026, the key to seeking Punitive Damages (also known as exemplary damages) is proving "Malice" under California Civil Code § 3294. What is the Legal Definition of "Malice" in 2026?

Under California law, "malice" does not necessarily mean the defendant intended to kill someone. Instead, it is defined as:

  1. Intentional Harm: Conduct intended by the defendant to cause injury; OR
  2. Despicable Conduct: Behavior carried on with a "willful and conscious disregard" for the rights or safety of others.

"Despicable conduct" is a high bar—it refers to actions so vile, base, or contemptible that they would be looked down upon by any ordinary, decent person. Common examples include extreme DUI (high BAC), street racing in residential areas, or a trucking company knowingly forcing a driver to operate a vehicle with failed brakes.

The 2026 Procedural Shift: Survival Actions vs. Wrongful Death

A critical distinction in 2026 litigation involves where these damages can be sought:

  • Wrongful Death Claims: Generally, punitive damages are not available in a standard wrongful death case in California unless the death resulted from a felony homicide for which the defendant was convicted.
  • Survival Actions (The Estate's Claim): This is where punitive damages are "unlocked." Because the claim is brought on behalf of the deceased person’s estate (CCP § 377.30), the law allows the estate to seek the punitive damages the victim could have sought had they survived.

Note: As of January 1, 2026, the temporary expansion of SB 447 has ended. While you can still seek punitive damages in a survival action, you can no longer recover for the decedent’s pre-death "pain and suffering" in cases filed this year. This makes the pursuit of punitive damages even more vital to ensure the settlement reflects the gravity of the defendant's malice.
